+1 862 207 3288 The House of Lords decision in Kennedy No. 2 has been influential on the law of causation and manslaughter; in particular cases regarding drug administration and joint responsibility. Comparing prior cases to the more recent decision in Kennedy No. 2 , it is now evident, that the courts embark on a different and a possibly more flexible approach especially with the interpretation of section 23 of the 1986 Act, regarding cases of manslaughter and the law of causation. Waller L.J. states the earlier authorities show that any unlawful act resulting in death would justify a verdict of manslaughter but modern authorities have restricted this form of manslaughter to unlawful acts which are dangerous.
