Case Analyses Format

The case analyses should be double-spaced with 1-inch margins, typed in 12-point Times New Roman font, and 4 pages in length (Not including the cover page or a reference page). As noted

above, cases “settled out of court” or determined “summary judgment” cannot be used for these assignments. The objective is to teach students about the law’s application to sport and/or

recreation. If a case has been settled out of court or summary judgment was determined, it does not teach the student about the application of law, as no application of law was applied.

Further, cases need to be “decided.” Students are not permitted to use any cases in progress, as no decision on the case also fails to teach students the application of law. Students should use

the following as an outline for each case:
Title and Citation
– Identify the case by its proper name, citation(s), court rendering the decision and date. Students must use the official citation (e.g., U.S. for Supreme Court cases, F.2d for U.S. courts of appeals,

F.Supp for federal district courts, N.C. for North Carolina Supreme Court) if an official citation is available.
Facts
– Describe the events, actions or circumstances that gave rise to the case. Further, describe the course of the dispute through the judicial system, including the outcome at each stage of the

trial and appeal proceedings.
Issue(s)
– Identify the question(s) posed by the litigation.
Decision
– Answer the question(s) posed in the Issue section. Also include previous decisions if heard by a lower level court.
Reasoning
– Clearly and briefly indicate the reason for the court’s decision(s) as presented in the trial judge’s opinion or, in appellate decisions, the majority opinion.
Reactions
– Your opinion(s) or reaction to the case and the court’s decision.
Implications
– How does this case impact sport and/or recreation management in the future?
