Thecasestudymethod isused toanalyzeSupremeCourtcases.Each casehasfiveessentialelements: thefacts,theconstitutional issue,theargumentsfor each side,thedecision and reasoningof theCourt, and theconsequencesof theCourt’sdecision.
FACTS OF THECASE: Whathappened in theoriginal case?When andWhere?Whoweretheparties involved?Istherealawbeing violatedor questioned?If so,whatlaw? Howdid thelowercourtsrulein thecase?
CONSTITUTIONALISSUE:Thisisthelegal questionbeing askedof theCourtand ismeanttobe answeredwithyesorno. Theissuemust bestated asa questionand mustincludethepartof the Constitution involved andtheconstitutionallyprotected right. This canbedifficulttofigureoutsouse thefollowing formula:
