CaseStudyMethod

Thecasestudymethod isused toanalyzeSupremeCourtcases. Each casehasfiveessentialelements: thefacts, theconstitutional issue, theargumentsfor each side, thedecision and reasoningof theCourt, and theconsequencesof theCourt’sdecision.

FACTS OF THECASE:  Whathappened in theoriginal case? When andWhere?Whoweretheparties involved?Istherealawbeing violatedor questioned? If so,whatlaw? Howdid thelowercourtsrulein thecase?

CONSTITUTIONALISSUE:Thisisthelegal questionbeing askedof theCourtand ismeanttobe answeredwithyesorno. Theissuemust bestated asa questionand mustincludethepartof the Constitution involved andtheconstitutionallyprotected right. This canbedifficulttofigureoutsouse thefollowing formula:

Firstanswer thefollowingquestionsabout your chosen case:

  1. Whowastheactorin thecase(personor group whodid theaction thatcaused thecasetoarise)?
  2. Whatwastheactionthatcausedthecontroversy?
  3. Whowastherecipient of theaction?
  4. Whatwastherightinvolved?
  5. Whatpartof theConstitution wasinvolved?

Second plug theanswersintothis sentence, orformula, forwriting theissue: When A did BtoC,did thisviolateC’srightto DunderE?

Example:BrownvBoard ofEducation of Topeka

When theBoardofEducation of Topeka,Kansas(A)denied therighttoattend aneighborhood whiteschool (B)toLindaBrown,anAfrican-Americanstudent(C),did thisviolateBrown’srighttoequal protectionofthelaw(D)undertheFourteenth Amendment(E)?

ARGUMENTS FOREACH SIDE:The petitioner is listed first in the case name and the respondent is listed second.Present arguments for the petitioner first and then present the arguments for the respondent. Discuss why each side believes that their position is correct. This will be supported by a law, a previous court case, or the constitution.

COURT’S DECISION, DISSENT, and REASONS:TheCourt’sdecision iswrittenin an opinion. Themajority opinion representsthe decision and reasoningof themajorityofthejustices. Sometimesjusticesagreewith the majorityastowho prevailed in thecasebutthey have differentor additional reasonstostate:thisis the concurring opinion. Thosewhodisagreeas towhoprevailed inthecasewriteadissenting opinion; several justicesmayjoin indissentor each maywritetheir own dissentingopinion. Describethereasons whytheCourtansweredtheConstitutional issuein favorof thewinning side(majority opinion, concurring opinion)and forthelosing side(dissent)inthecase.

CONSEQUENCESOF THEDECISION:Whatchangesoccurred asa resulttheCourt’sdecision? Did the Courtstrike down orsupportan existing law?Did thedecision includerecommendationsfor writing a newlawif it did strikedown an existing law?
