THE BASICS
The court report is worth 40%, and should be no more than 2,000 words.
The specific objective of this assessment is to develop your knowledge of legal proceedings and to increase your ability to critically analyse the criminal justice system from a sociological perspective.
For the purposes of the court report and the critical analysis of court proceedings you are required to base your observations of AT LEAST one full day or two half days ofproceedings in two courts, the Local Court AND District Courts.
Local Court and District Courts are located in central Sydney, throughout the metropolitan region and in some country towns; some of the courts handle much more cases than other courts. General information
It is your responsibility to identify the courts you prefer to visit. Start with checking the Local and District court websites or phone book if you need addresses and phone numbers. The Local and District courts are open to the public, but they may be closed to hear particular matters such as those involving children and young people or closed for procedures such as hearing the evidence of an alleged victim of sexual assault. In many of the courts, different days are set aside for different types of matters, so it is worth to familiarise yourself with the routines of the courts you plan to visit.
The course is focused on criminal matters and trials so these are the court matters that you should select, not civil or family law matters. The criminal matters that are relevant to the assignment are sentence hearings. The best way to establish the courts schedule is to follow the website link to the Court you wish to visit.
It is essential that a court official is informed as a matter of courtesy of the purpose of your visit, to research for a university assignment, so that note taking in court does not arouse any suspicion and concerns. This is an individual assignment – do not attend the courts in groups.
Before your visit
If you do not know much about court procedure read the suggested references and make notes of any terms you do not understand and raise the issues in the tutorials for discussion and clarification. It will help you with your observations if you have a satisfactory understanding of what is going on.
Make sure you understand the question. Read the suggested readings; make notes of key phrases and terms you need to know. You also need to know in general terms about the level of seriousness of offences dealt by the Local Court in criminal matters and the limits to magistrates sentencing powers. This will be dealt with in the lectures and tutorials.
