This is a case that involves arbitral review of discipline imposed on an employee for tardiness. A grievance was filed charging that there was not just cause for the discipline (a ten-day suspension). Each segment runs less than ten minutes. You will need to watch all five segments before you before you can prepare this research paper.
After you have developed a thorough understanding of the seven tests (attached to this order) of just cause and have viewed the video, you need to address the following issues in your research paper:
• Summarize the union advocate’s argument in favor of the conclusion that the employer did not have just cause for issuing the ten-day suspension.
• Summarize the employer advocate’s argument in favor of the conclusion that the employer had just cause for issuing the ten-day suspension.
• Apply the seven tests of just cause to the facts of the case that were developed during the arbitration hearing. Ask each of the seven questions and thoroughly answer them. Then, play the role of the arbitrator by deciding whether the employer had just cause to issue the employee the ten-day suspension. You need to make a decision. If you decide that the employer did not have just cause, make sure you decide how the improperly imposed discipline can be remedied.
