prohibited. The court’s decision in Cassis de Dijon was a manifestation of this. However, as

subsequent case law has demonstrated, the principles established in Dassonville and Cassis

de Dijon have caused more legal problems than they have solved and the attempts by the

court to resolve these problems have not worked. The only viable solution is now to abandon

these principles entirely.’
