It is often stated “possession is nine-tenths of the law.” Although the adage is not literally true, it demonstrates the importance of possession in Anglo-Australian law. Using illustrations, especially, from decided cases, discuss the concept of possession, its role and the policy consideration that underlie possession in Australian Law.
