You will write two analytical paper assignments for this course.
You must clearly cite all sources and include an additional reference page.
The content of the paper should be at least 8 pages in length( not including cover page and bibliography), 12 pt. font, and double spaced. The papers should comply
with APA citation.
Citation Requirements: You must use at least 6 citations for your final paper, including 3 articles from relevant journals and two citations from the textbook
(Judicial Process & Judicial Policymaking, 5th edition) or lecture notes (I can send these to you if you need them) to support your argument. These should be properly
cited with a separate work cited page. You earn credit for required citations.

For both papers, you need to raise an effective thesis or research question of your interest. I give you complete flexibility to create a research question, but it
must be within the realm of judicial policy and social process or relate to the materials we covered in class throughout the semester.
The first paper is a literature review on your specific research question. In this paper, you must raise
your argument, thesis, or research question, and cite at least six references to support your main point. The second paper is an extended project built upon your first
paper and a full version research project on your research topic.
The first literature paper is worth 30 points and the second full paper is worth70.
Your presentation is worth 40 points. Your analysis will allow me to assess the development of your
comprehension and application of the course materials, while training you to critically write about issues on judicial policy and social process.
My feelings on the paper:
Why do Supreme Court judges and judges in general have so much discretion? Where do we draw the line? The topic I want to address is the issues with trying juveniles
as adults and what type of sentencing they get, when in fact they are not adults.
Depending on the jurisdiction, where the crime took place and the judge all are in most part what will determine much of what happens to you regardless of your
history. There is of course, the law and precedence, so they say. Yes we all have history but just how bad is it? Many juveniles are tried as adults on a first time,
non violent offense without ever being tried as a juvenile and sent to a juvenile prison. Who makes the decision of whether to try a juvenile as an adult? What gives
them that right when in fact they are juveniles? Criminal Law affects the rights and aspirations of minorities, the poor, and juveniles. Power, Discretion, judges has
it.
Some Cases:
There are some cases such as the Atkins case and the Stanford v. Kentucky where judges decide two totally different outcomes relating to the execution of juveniles.
The 8th amendment never changed but the decisions of the judges did. How is this?
Judges have too much discretion. We could look at Marbury v. Madison and that should tell you something about the power and discretion judges have.
On the federal and state levels what determines a juvenile needs to be the same for all. A juvenile in one state should be a juvenile in all states. A law in one state
should be the law for all states.
Judges can change statutes and make decisions based on the constitution, laws, and there discretion, what they believe to be good.
Their opinion. If this was not the case then all of the decisions that came about involving juvenile?s cases would come out basically the same.
I guess what I am trying to point out is I feel that I feel that judges have too much discretion and power. I would like to try and use juveniles and cases, to confirm
that judges do have too much discretion and power. You can use other things too.
I write a lot relating to juveniles and my professors are very aware that is where my passion lies.

I have to have the first part of my paper (literature review/ 4 pages + cover page and bibliography page) turned in by April 1st and the second part or the final paper
(remaining 4pages + cover page and bibliography page) by April 23rd.
I guess you could just write the paper and I would have to figure out what to put in the citation page for the literature review and what to put in the citation page
for the total paper. ?? Whatever is best?
