To complete this assignment you are required to undertake the following three tasks and discuss them. Credit will be given for the use of relevant case law.
Task 1
The Occupier’s Liability Acts 1957 and 1984 relate to different types of visitors to the premises. Briefly explain the duty an owner of the premises owes to a visitor under each of the Acts. Support your answer with one example under each Act. (Total Marks 35, Word Limit 350)
Task 2
Describe, using an example, what is meant by strict liability in tort. Evaluate the key differences between strict liability and a fault based approach. (Total Marks 30, Word Limit 300)
Task 3
Understand and apply the elements of the Tort of Negligence to the following incidents that take place in a large toy factory.
Terry is employed as a cleaner in a large toy factory. His key responsibility is to ensure that the factory floor is clean at all times. Raymond, Joe and some other staff members often ask Terry to help clean other areas in their workplace. One day Raymond asks Terry to help him move boxes of toys from one part of the factory to another part within the factory. He asks Terry to drive the forklift truck to move these boxes. Terry has never driven a forklift truck before and he admits his lack of confidence but agrees when Raymond insists.
Terry starts the truck but loses control. He hits into some heavy boxes, one of which falls onto a co-worker Andy who is critically injured.
Mark is a delivery driver. He receives a call from his daughter’s school informing him that his daughter has injured herself in a sports event. He is on his way to deliver toy boxes to another factory plant so he decides to take the works’ van to pick up his daughter and to make the delivery on the way to his home. However, after making the delivery he negligently crashes the van. The van crashes into Susan’s car and Susan is severely injured. Susan was not wearing her seat belt.
Use the rules on both negligence and vicarious liability to consider whether Andy and Susan will be able to claim for their injuries. (Total Marks 35, Word Limit 350)
