The Question
Amanda and Bill’s parents, Carol and David, died suddenly in a car accident last month, they both left identical wills, appointing Amanda and Bill as executors and leaving everything to be divided equally between them. The only thing of value they left was the family home ‘Greenacres’ worth £400,000. Carol and David were the registered proprietors, and held the property for themselves and Bill in common. Carol and David had a 25% share each. Bill owned the remaining 50% in equity, as this was the agreement when he moved back to the family home and paid off the remaining mortgage when Carol and David had some financial difficulties 10 years ago.
Amanda lives with her daughter, Edith who is six years old and her son, Fred, who is four years old and has a mild physical disability. The children’s father no longer lives with them but provides some limited financial support.
Amanda believes that she has inherited a share in the family home and that Bill should ‘buy her out’. Bill contests this, as he has continued to live at Greenacres and believes that the property is his and he does not owe Amanda anything.
Amanda is quite desperate as she is struggling to make her mortgage payments and believes there is a risk of losing her current home.
Bill lives alone and while he used to have a large income, the financial downturn has hit his business hard and he has much reduced means. If he had to pay Amanda he would need to sell Greenacres as he would be very unlikely to obtain a loan by way of a mortgage due to his reduced income.

Advise Amanda whether she has an interest in Greenacres and if she does how she can realise her share of it, whether by forcing Bill to sell it, moving in with her children, or any other legal remedy?.
